Product liability law is one of the greatest consumer protections in the United States, as  it holds companies responsible for the products they create.

There are four main types of product liability: negligence, breach of warranty, strict liability and misrepresentation.

  • Negligence occurs when a product causes someone harm. An example of negligence could be a car accident caused by faulty brakes, a fall from an extension ladder that didn’t lock properly, or a prescription drug that was put on the market without being thoroughly tested for side effects.
  • Breach of warranty is when a person buys a product because of what the seller claims it will do, when in fact the seller knows full well that it will not work. Miracle tonics and remedies are notorious for breach of warranty.
  • Strict liability is when the dangerous actions of one person or organization causes harm or property damage to another person, regardless of whether that action was intended. For example, if you are attacked by an animal at a zoo, the zoo may be liable for your injuries regardless of whether the animal was properly trained or controlled.
  • Misrepresentation is the legal term for lying. Misrepresentation cases can result from almost any situation in which a person is injured – financially, physically or otherwise – because of someone else’s intentional deceit.
